General Terms of Use for Meta Presence

By using Meta Presence and its applications, anyone who makes use of them (hereinafter also referred to as the “User”) accepts these general terms and conditions.
The owner and provider of Meta Presence is Techstar srl, with its registered office in Pasian di Prato (Ud) at Via Cotonificio 84 (VAT no. 03035830300) – email: contact@techstar.it (hereinafter also referred to as “Techstar”).

Preamble

The following general terms and conditions govern the use of Meta Presence:

• Users can browse and use the services provided, strictly adhering to these terms and conditions;
• Techstar reserve the right to amend these terms and conditions at any time; any amendments will take effect from the date they are published on the platform itself: the User is therefore required to review them via the designated link;

User obligations

• the User must use Meta Presence in strict compliance with these General Terms and Conditions;
• It is the User’s responsibility to read these terms and conditions and to check for any changes that may have been made to them;
• access to the internet, which is required to use Meta Presence, along with all related charges and costs, including connection fees, are the responsibility of the User, who must independently obtain any necessary hardware or software;
• The User is solely responsible for the operation and maintenance of their equipment and for taking all necessary measures to ensure their online safety;
• the User undertakes not to use Meta Presence and its services for any purpose that is illegal or contrary to these terms, or in any way that could damage its functionality, render it unusable, cause overloading, deterioration, and/or interfere with its use by other Users;
• the User may access Meta Presence and browse its various pages, taking advantage of the services made available to all Users;
• If the User uses the forms in Meta Presence, they have the obligation and responsibility to provide personal data that is true, correct, verifiable, and up to date.
  The personal data provided by the User via these forms will be processed by the Data Controller, whose Privacy Policy should be consulted, in compliance with data protection legislation. The processing will be for the purposes and in the manner described in the specifically prepared notice, which is published so that it is easily accessible to Users.

Responsibilities

• the User uses Meta Presence “as is”, meaning as it is offered and available at the time they connect and view its content;
• Techstar is not liable, either to the User or to any parties directly or indirectly connected to the User, for any damages, claims, or losses resulting from disruptions or suspensions of the Meta Presence service that are caused by the User, by third parties, or due to force majeure or unforeseeable circumstances;
• except as contractually and individually defined in relation to specifically assumed obligations, Techstar reserves the right, at any time, without any form of notice and without any obligation to pay compensation, and at its sole discretion, to close Meta Presence and/or make any changes and/or additions to its content that it deems appropriate;
• the User uses Meta Presence and the services they are permitted to use, thereby substantially and procedurally indemnifying Techstar against any party for legal/civil or administrative disputes, costs, expenses, and damages of any kind caused by the use or inability to use the service;
• the User agrees that Techstar shall not be held liable for any omissions or errors that may be contained in the materials and information transmitted via Meta Presence;
• the existence of a hyperlink (link) to Meta Presence from another third-party website, or from Meta Presence to another third-party website, does not imply Techstar’s approval or acceptance of responsibility for the content or use of the sites linked in this way;

• Meta Presence and its content are owned by Techstar and/or its licensors or assigns and/or third parties where indicated, and are protected by current legislation on the protection of intellectual and industrial property rights;
• Unless otherwise specifically provided, all materials available on Meta Presence (including, but not limited to, logos, trademarks, and other distinctive signs, photographs, etc.) may be used solely for informational and/or personal purposes. Any other use requires the express prior authorisation of Techstar or, if different, the holder of any rights exercisable over them. Any commercial use or distribution is expressly prohibited unless expressly authorised.
• Any product or company names mentioned in Meta Presence may be trademarks of their respective owners, and therefore unauthorised use of these names is expressly prohibited;
• Reproducing the graphics and structure of Meta Presence is prohibited.
  The constituent elements of Meta Presence may not be copied or imitated;
• The User is not granted any rights to the software related to Meta Presence, including updates, or to its source code.
  The User is expressly prohibited from carrying out the activities referred to in Article 64-bis of Italian Law 633/41, including but not limited to: extracting, reproducing, translating, adapting, distributing to the public in any form, or transferring the software to third parties for any reason, whether for a fee or free of charge.
  Without Techstar’s express authorisation, the User is prohibited from making any changes to the software, even to correct any faults and/or defects, as well as from duplicating, decompiling, disassembling, transforming, or modifying the software;
• all rights not expressly granted are reserved;

Privacy

Amendments and final clauses

• Techstar reserves the right to make changes to the Site and these General Terms of Use at any time.
  The User must always refer to the text of the Terms and Conditions published on Meta Presence at the time of consultation as the current version;
• These terms and conditions are drawn up in Italian;
• the fact that one of the parties does not, at any time, enforce the rights granted to it by one or more clauses of these conditions shall not be construed as a waiver of those rights, nor shall it prevent it from subsequently demanding compliance with any and all contractual clauses;
